Participant Portal Terms and Conditions

Thank you for visiting the OurDNA Portal.

OurDNA is the flagship initiative of the Centre for Population Genomics (CPG). CPG is a collaboration between the Garvan Institute of Medical Research (GIMR) and the Murdoch Children’s Research Institute (MCRI). The OurDNA project is seeking to create the first large-scale genomic data resource designed to improve the representation of culturally and linguistically diverse Australians.

The OurDNA Portal is solely the responsibility of the Centre for Population Genomics. This Portal is owned and administered on behalf of the Centre for Population Genomics (CPG) by the Garvan Institute of Medical Research (GIMR).

These terms of use (Terms), together with our Privacy Policy, govern your access to and use of this site. We may amend or update the Terms at our discretion. You should check this page from time to time to ensure that you are happy with any changes. By continuing to use this website, you accept the Terms.

You should review the OurDNA Privacy Policy and these Terms carefully and immediately cease using the site if you do not agree to these Terms.

In these Terms, ‘us’, ‘we’ and ‘our’ means GIMR as site administrator.

Registration

You must be a registered user to access the OurDNA Portal.

When you register and activate your account, you will provide us with personal information such as your name, email address, telephone number, address, date of birth, contact details for your next of kin. For people registering as a parent/guardian or carer you will provide us with the personal information of the minor participating in the study such as name and date of birth. You must ensure that this information is accurate and current. You consent to us handling all personal information we collect in accordance with our Privacy Policy.

When you register and activate your account, we will provide you with a username and password. You are responsible for keeping this username and password secure and are responsible for all use and activity carried out under this user name.

To create an account, you must:

  • be an Australian resident; and

  • have signed a patient consent form/s for the OurDNA study.

Use of the OurDNA Portal

By registering to use the OurDNA Portal, you agree to:

  • comply with these Terms at all times;

  • ensure that any details you choose to submit to us or stored on the Portal is current and accurate;

  • monitor any electronic system or address designated by you for the purpose of receiving communications (we will not be liable for any delay or failure by you to do so);

  • ensure that all information you submit to us, upload to the Portal or provide to another user of the Portal, is true and correct and does not infringe the rights (including intellectual property rights) of any other person; and

  • maintain and safeguard the privacy and security of all personal or confidential information that you obtain access to in relation to the Portal.

Collection Notice

We collect personal information about you to provide you with the ability to manage your consent preferences in relation to your personal information and for purposes otherwise set out in the Privacy Policy.

We may, on a confidential basis, disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our alliance partners) or as required by law. If you do not provide this information, we may not be able to make the OurDNA Portal functionality available to you.

Our Privacy Policy explains: (i) how we store, use and disclose, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.

Your health information

We collect health information about you in order to provide you with our services and the option of contributing to other research. Any collection of health information will be handled in accordance with our Privacy Policy, as well as applicable State and Territory privacy and health data protection laws, including for example the Health Records and Information Privacy Act 2002 (NSW).

Accuracy, completeness and timeliness of information on the OurDNA Portal

The information on the OurDNA Portal is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on the OurDNA Portal, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on the OurDNA Portal. You should monitor any changes to the information contained on the OurDNA Portal.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of the OurDNA Portal or a linked website. You must take your own precautions to ensure that whatever you select for your use from the OurDNA Portal is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.

We may, from time to time and without notice, change or add to the OurDNA Portal (including the Terms) or the information described in it. However, we do not undertake to keep the OurDNA Portal updated. We are not liable to you or anyone else if errors occur in the information on the OurDNA Portal or if that information is not up-to-date.

Security

While we will always use our best endeavours to implement security controls and prevent unauthorised access to, or use of, the OurDNA Portal, you acknowledge that the internet is an insecure public network where there is a risk that your use of, and interactions with, the OurDNA Portal may be viewed, intercepted or modified by third parties and that the OurDNA Portal and any information on it may contain harmful code.

To the extent permitted by law, we do not guarantee that there will not be, or accept any liability for, any harmful code on the OurDNA Portal or a breach of security by a third party or any interference with or damage to your computer system, software or data occurring in connection with or relating to your use of the OurDNA Portal.

Whilst we endeavour to provide continuous access to the OurDNA Portal, we do not warrant that your access will be uninterrupted, timely, secure or error-free.

Your access to the OurDNA Portal may be suspended in the case of system failure, maintenance, repair or any reason beyond our control.

Linked sites

The OurDNA Portal may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

Intellectual Property

Unless otherwise stated, all copyright and other intellectual property rights subsisting in the information and content provided on this website, including, without limitation, the software, design, text and graphics comprised in the site and the selection and layout of the site, are owned by us, our related parties or our third-party licensors.

Use of any content and related graphics on this website are for your information and/or personal use only in accordance with all applicable laws. Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purposes or to print extracts for personal use. No documents, graphics or notices (including copyright notices) in our content or otherwise on this website are to be modified in any way. Graphics on this website are not to be used separately from the accompanying text.

No part of this website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service. Reproduction or redistribution of the OurDNA Portal or its content is expressly prohibited and may result in civil and criminal penalties. In addition, you must not copy the content to any other server or location.

No commercial use

For you, the OurDNA Portal is for personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products or services contained within the OurDNA Portal. You may not use the OurDNA Portal, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own website.

Unacceptable activity

You must not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to the OurDNA Portal, including but not limited to:

  • any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other legal rights of individuals;

  • using the OurDNA Portal to defame or libel us, our employees or other individuals;

  • uploading files that contain viruses that may cause damage to our property or the property of other individuals, introduce any harmful code into the OurDNA Portal or use it in a manner that could damage, disable or impair our services or system;

  • use any robot, scraper or other means to access the Portal for any purpose; and

  • posting or transmitting to the OurDNA Portal any non-authorised material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is defamatory, racist, obscene, threatening, pornographic or otherwise or which is detrimental to or in violation of our systems or a third party’s systems or network security.

If we allow you to post any information to the OurDNA Portal, we have the right to take down this information at our sole discretion and without notice.

Your liability

You are liable for and must indemnify us, and our related parties (including our affiliates, partners, licensors and contractors) against all losses, costs, expenses (including legal costs on a full indemnity basis), claim or damage suffered or incurred (or agree to pay by way of settlement or compromise) in connection with or arising out of your breach of these Terms.

Warranties and disclaimers

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about the OurDNA Portal or its content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that the OurDNA Portal will be secure.

We reserve the right to restrict, suspend or terminate without notice your access to the OurDNA Portal at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

Our Liability

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of the OurDNA Portal and/or the information or materials contained on it, or as a result of the inaccessibility of the OurDNA Portal and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

Jurisdiction and governing law

Your use of the OurDNA Portal and these Terms are governed by the law of New South Wales and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
